LEGAL DESCRIPTION: The E 1/2 NE 1/4 of Section 11, Township 14 North, Range 11 West of the 6th P.M. Howard County, Nebraska (taxed as 78 acres which does not include a previously sold building site with 2 acres).

AND

The NW 1/4 of Section 12, Township 14 North, Rage 11 West of the 6th P.M. Howard County, Nebraska (taxed as 144 acres including building site with blue harvestor).

GENERAL INFORMATION: This all adjoining combination cropland and pasture land farm is being sold at public auction by the heirs of the Marion R. Groteluschen Estate.  It will first be offered as 4 smaller tracts, then in combination of tracts, selling in the manner creating the highest total dollars for the sellers.

TRACT #1: One of the tracts offered would split off an existing building site that has a large number of young and mature blue spruce, evergreen and shade trees surrounding an older, fixer upper, farm home, blue harvestor and a couple of out buildings.  This peaceful yet well located site would also be ideal for new home construction for anyone wanting to get away from the hustle and bustle of city life.

Any and all improvements will be sold as-is, without warranty or guarantee as to condition.  Number of acres to be included in this tract shall be at the discretion of the sellers and will be determined by auction day.  Interested buyers should relay their desires as to the number of acres they would like to see included.

A professional survey will be required to determine an exact legal description of this property.  Cost of survey will be divided equally between seller, buyer of tract #1 and buyer of adjoining land involved.

TRACT #2: This tract will contain the balance of land in the NW 1/4 of Section 12 not taken by the acreage in tract #1.  Prior to acres taken by Tract #1, the FSA shows the NW 1/4 of Section 12 to have approximately 57.72 Irrigated cropland acres, 16.27 non-irrigated cropland acres and 70 acres of non cropland.  At present, the NW 1/4 of Section 12 is taxed as 144 acres with 2008 taxes at $1,868.40.  Cost to survey off acreage in tract #1 will be divided equally between seller and buyers of tract 1 & 2.

TRACT #3: This tract will be Tract #1 and Tract #2 combined into one tract of 144 acres.

TRACT #4: This tract is approximately 78 acres, unimproved, in the E 1/2 NE 1/4 of Section 11.  The FSA records indicate the farm has 39.77 irrigated cropland acres and the balance non cropland.  This tract is taxed as 78 acres with the 2008 taxes at $1,149.34.  (Building site in the E 1/2 NE 1/4 of Section 11 is not included as it had been sold in previous years.)

TRACT #5: This tract will be all tracts combined into one tract of 222 acres.

FSA INFORMATION: 113.8 cropland acres with a 93 acre corn base and a 6.9 wheat base.

SOILS INFORMATION: Holder Silt loam, Coly-uly Complex.

TERMS OF SALE: The terms of sale are cash with a 15% down payment immediately following the auction at which time the buyer or buyers will be required to enter into a written purchase contract calling for the balance on or before March 1, 2009, the date of final closing.  Possession on final closing.  The seller will be paying the 2008 taxes and the buyer or buyers paying the 2009 and all subsequent years' taxes in full.  Cost of title insurance and the costs associated with closing will be divided equally between buyers and sellers.  Any difference in acres, plus or minus, that might be determined as a result of that survey shall not change the sale price of that tract or any other tract involved in this auction.  Any and all base acres which the FSA office shows the property to have will pass to the buyer(s).  Any announcements made day of auction shall take precedence over any earlier announcements, verbal or written.  Information contained herein is from sources we deem reliable, however is not guaranteed.  No warranty is made or implied as to property boundaries, soil productivity, or water supply.  Buyers should inspect the property, gather their own information, and bid accordingly.  This property, like property that sells anywhere, is being sold subject to all easements, gas, oil or mineral reservations and all restrictions of record if there are any.  Buyers are reminded this is a cash sale.  Any needed financing should be arranged prior to bidding.  Fowlkes Realty and Auction Co., Inc. and its agents represent the seller as sellers' agents.
